Terms of Use
Effective Date: March 5, 2026 These Terms of Use ("Terms") govern your access to and use of Cloud Savant (the "App") and any related websites, APIs, and services we provide (collectively, the "Service"). 1. Apple EULA and Priority
Your use of the iOS App is also subject to Apple’s Licensed Application End User License Agreement ("Apple EULA") unless a custom EULA is presented to you. These Terms apply to the Service (including subscriptions and cloud connectivity). If there is a conflict between these Terms and the Apple EULA regarding the app license itself, the Apple EULA controls. 2. Eligibility and Account Responsibility
You must be able to form a binding contract in your jurisdiction to use the Service. You are responsible for your use of the Service and for ensuring any person who uses the Service through your device/account complies with these Terms.
3. The Service and Cloud Integration (CloudFormation / Read-Only Access)
Cloud Savant provides cloud insights and analytics based on configuration and usage data you authorize us to access from your cloud environment (for example, AWS). Customer Cloud Deployment: Certain features require you to deploy and maintain one or more CloudFormation stacks (or equivalent infrastructure) in your cloud account(s) to enable read-only access for data collection and analysis. Permissions and Scope: You control what permissions are granted by the stack(s) you deploy. The Service is designed to operate with read-only access as described in our documentation; however you are responsible for reviewing and approving the permissions included in any template or stack prior to deployment, and for maintaining your cloud environment security posture (including IAM, role trust policies, external IDs where applicable, and organization/account settings). Changes and Availability: Cloud providers may change APIs, permissions models, or behavior. We may modify the Service to maintain compatibility. We do not guarantee that all features will be available for every cloud account configuration or region. No Cloud Provider Affiliation: Unless explicitly stated, we are not affiliated with, endorsed by, or sponsored by any cloud provider.
4. Subscriptions and Billing (Auto-Renewable)
Some features require a paid subscription ("Subscription"). Subscriptions are offered as auto-renewable in-app purchases through Apple’s App Store. Billing Through Apple: Payment is charged to your Apple ID at confirmation of purchase. Your Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. Managing and Canceling: You can manage or cancel your Subscription in Apple account settings (iOS: Settings → Apple ID → Subscriptions). Cancelation takes effect at the end of the current billing period. We cannot cancel subscriptions for you. Prices, Trials, and Promotions: Subscription prices, availability, and any trial/promotional terms (if offered) are displayed in the App Store at the time of purchase and may change in accordance with Apple’s policies. Taxes may apply. Refunds: Refund requests are handled by Apple under App Store policies; we do not issue refunds for App Store purchases.
5. Privacy
Your use of the Service is subject to our Privacy Policy: https://cloudsavant.info/privacy-policy/ If there is a conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.
6. Acceptable Use
You agree not to: • Use the Service in a way that violates any law, regulation, or third-party rights. • Attempt to gain unauthorized access to systems, accounts, or data. • Interfere with or disrupt the Service, including probing or scanning for vulnerabilities. • Reverse engineer the Service except where prohibited by law. • Use the Service to develop or benchmark a competing product (unless permitted by law). • Upload or transmit malicious code.
7. Customer Data and Outputs
Your Data: You (or your organization) retain rights to the data you provide or make available through your cloud account(s) ("Customer Data"). Our Use to Provide the Service: You grant us a limited right to process Customer Data solely to provide, maintain, secure, and improve the Service; generate insights/reports for display in the App; and create aggregated or de-identified metrics where permitted by law and consistent with the Privacy Policy. Accuracy: Insights are generated from available inputs and heuristics. You are responsible for verifying results and decisions made based on them.
8. Intellectual Property
The Service (including software, visual interfaces, designs, templates, trademarks, and documentation) is owned by us or our licensors and protected by intellectual property laws. You receive only the rights expressly granted under these Terms and the Apple EULA.
9. Third-Party Services
The Service may rely on third-party services (for example, cloud provider APIs). We are not responsible for third-party services, and they may have their own terms and policies. Your use of those services is governed by your agreements with them.
10. Security
We implement reasonable administrative, technical, and organizational safeguards designed to protect the Service and Customer Data. No system is completely secure, and we cannot guarantee absolute security. You are responsible for securing your devices, Apple ID, and cloud accounts.
11. Termination and Suspension
We may suspend or terminate your access to the Service if you violate these Terms, if your use poses a security risk or could expose us or others to liability, if required by law, or if the Service is discontinued. You may stop using the Service at any time. If you cancel a Subscription, you retain access until the end of the paid period (subject to Apple rules).
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INSIGHTS, REPORTS, OR RECOMMENDATIONS WILL BE ACCURATE OR COMPLETE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR US $50 IF YOU HAVE NOT PAID ANY AMOUNTS). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Cloud Savant, LLC. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: • Your use of the Service. • Your cloud account configuration and permissions you approve/deploy. • Your violation of these Terms or applicable law. • Your infringement of any third-party rights.
15. Governing Law and Venue
These Terms are governed by the laws of Maryland, United States, without regard to conflict of laws principles. Any dispute arising from these Terms or the Service will be brought in the courts located in Rockville, Maryland, and you consent to personal jurisdiction there.
16. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice via the App, our website, or other reasonable means. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
